GTC

Area of Application
These General Terms and Conditions (GTC) apply to all services and products that Velumount GmbH provides to the customer. When registering or ordering a service or product of Velumount GmbH, the GTC are considered accepted by the customer.

Conclusion of the contract
Registrations for chargeable adjustments are binding. For cancellations less than 24h before the start of the adjustment, a basic fee of CHF 100.- is owed.

Products / Services
Velumount is a product for stabilization of soft tissue in the upper airway and is used for self-treatment of snoring and obstructive sleep apnea. The Velumount team teaches the basic knowledge necessary for self-application of the Velumount method.
The instructions for use of the Velumount products, which are given during the initial fitting, must be observed.
Polygraphy measuring devices, which Velumount GmbH lends out, are used to check the function of the Velumount method. For final checks of the therapy, the patient can contact a specialist.

Delivery / Shipping
For initial fitting: The Velumount product can be taken home after fitting. Reorder by shipping: Delivery is normally made within five working days exclusively to a delivery address in Switzerland. Before public vacations or company vacations, the delivery time may be delayed. All shipping and packaging costs shall be borne by the customer.

Customer's duty to inspect
The customer must check delivered or collected products for correctness and completeness. All defects in the product must be reported by the customer to Velumount GmbH within five working days of receipt. In the event of a claim for a defect, the Customer shall keep the product as received in its original packaging. Velumount GmbH requests the customer to return the defective product with a description of the defect or to hand it in personally at the responsible location. Otherwise, the product is considered accepted by the customer.

Liability
Liability is governed by the applicable statutory provisions. However, Velumount GmbH is in no case liable for negligence of the customer, indirect and consequential damages, whether contractual or non-contractual. Velumount GmbH is furthermore not liable for damages caused by any of the following:

a) Improper storage, adjustment or use of Velumount products.

b) Failure to maintain and / or improper modification or repair of Velumount products by the customer or a third party.

c) Use of Velumount products longer than the specified maximum duration of use, see point 9.

Warranty policy of Velumount products
Velumount products Original, Intro and Rhinomount are guaranteed for three months from the date of purchase. In case of wire breaks and/or leaking sheath, the Velumount product Original or Intro will be replaced free of charge within the corresponding period. Defective Velumount products are to be returned either to your responsible location or to Velumount GmbH, Zeughausgasse 16, 3011 Bern.

Restrictions on use/precautions
For the following groups of persons, Velumount products may only be used under the following conditions:

a) Persons suffering from epilepsy may only use Velumount after consultation with their physician.

b) Persons suffering from chronic diseases whose treatment involves medication for blood thinning (except aspirin products) are requested to inform this at the beginning of an adjustment. Velumount products must not be used in the following groups of persons:

a) Children and adolescents under 16 years of age.

b) Persons with reduced physical, sensory or mental abilities who, because of these deficits, cannot learn to use Velumount products safely.

c) Persons with severe liver disease or alcoholism, since venous blood vessels in these cases may tend to bleed profusely in the esophagus (esovagus varices).

Useful life
Velumount Original (classic brace): 6 months

Velumount Intro (ring): 6 months

Rhinomount nasal cannula: 6 months

Return policy

The right to return requires at least one visit to a control appointment. A control appointment is an elementary part of a customization. This gives Velumount the opportunity to adjust the product more optimally to your needs. The right of return is granted up to three months after the initial fitting appointment. After deduction of the sales price of the returned braces, you will receive half of the fitting costs (max. CHF 260.-) back.

Prices/Conditions of payment
Prices are in Swiss francs, incl. VAT. In case of price changes or deviations, the seller is entitled to adjust the prices accordingly. This also applies to services and additional services whose usefulness only becomes apparent during the performance of the service. After prior consultation with the customer, the services in question will be invoiced additionally. The adjustment of Velumount products is to be paid directly at the respective location. The payment options may differ depending on the Velumount Ltd location.

Applicable Law, Jurisdiction

The legal relationships are subject to Swiss law. The exclusive place of jurisdiction for all disputes is Bern.
